A palm tree, an HOA dispute, and a neighbor allegedly showing up with a baseball bat. All over what someone planted in their front yard.

It sounds ridiculous, but disputes over landscaping are nothing new in HOA communities. The real question is how much control a homeowners association has over someone's property.

In a recent episode of The Daily Law Podcast, Attorney Jonathon Daily reacts to the viral confrontation and explains where Florida law draws the line.

Can an HOA Control Your Landscaping in Florida?

Florida homeowners associations can enforce certain landscaping and architectural rules. However, those rules aren't unlimited.

Under Florida Statute § 720.3075 , qualifying Florida-friendly landscaping receives legal protection. An HOA generally cannot enforce its governing documents in a way that prohibits homeowners from implementing landscaping protected by that statute.

That doesn't mean homeowners can plant anything they want, wherever they want. The type of landscaping, applicable restrictions, and circumstances still matter.

Florida Laws That Limit HOA Power

Florida has also adopted protections that limit certain HOA restrictions.

For example, Florida Statute § 720.3045 restricts an association's ability to regulate certain items that aren't visible from specified locations, subject to applicable laws and ordinances.

Other provisions address architectural decisions and restrictions that conflict with homeowners' legal rights.

Attorney Daily discusses why homeowners should understand these protections before assuming an HOA has the final say.

A Disagreement Doesn't Justify Taking Matters Into Your Own Hands

There's another part of this viral video that deserves attention: the confrontation itself.

Whether you're frustrated with your HOA or angry with a neighbor, threatening someone isn't the way to settle a property dispute.

You can disagree with someone without making the situation worse. If you believe an HOA is acting unlawfully, there are legal options worth exploring.
