Types of Separation #3
What is permanent separation?
Permanent separation is when the couple decides to go separate ways for good.
What about assets and debts?
Most states consider debts and assets to be separate after permanent separation. Only debts incurred for necessary reasons like providing for children are considered joint.
What is the difference between permanent and legal separation?
Legal separation is when the couple seeks legal help. Divisions of assets and properties, child custody and support, and visitation rights require court-issued judgment legal separation takes place.
Is legal separation the same as divorce?
No. Though living separately, legal separation still considers the couple married but is issued a court order that mandates their duties and responsibilities. On the other hand, divorce dissolves the marriage ultimately.
